Daniel Kelly was born circa 1790 in County Clare, Ireland .

Daniel Kelly was convicted of 7 years transportation in County Clare, Ireland in March 1818. He arrived in New South Wales aboard the Earl St Vincent on 16 December 1818, with a stated age of 27. He was 5' 5 3/4" (167cm) tall, ruddy complexion, dark sandy hair, and hazel eyes. A stonemason by trade his services were much needed in the Colony.

Sent to Parramatta Daniel met Ann Whelan, who had also been senteced to 7 years transportation. She had arrived in the Colony on 3 May 1820. On 8 November 1820 they requested permission to marry.

Despite being married, Ann is shown in the 1822 census as living at the Female Factory in Parramatta. Daniel is shown incorrectly as being a butcher in Sydney.

In 1822 Daniel's first daughter Bridget Margaret was born.

In 1823 Daniel is a houskeeper and labourer-servant of Mr Watkins at Parramatta, and in that year Daniel received his ticket of leave.

On 17 March 1825 Daniel received his Certificate of Freedom.

In 1826 Daniel's second daughter Catherine was born.

In the 1828 census Daniel, Catholic, aged 38, is shown with his daughter Bridget Margaret (shown in the census as Margaret, 5 yrs) but without his wife Ann and baby daughter Catherine. It is therefore likely that both Ann and their baby daughter Catherine were deceased before the census was taken. Daniel is shown as a stonemason employed by Mr Lawrence Moore in George St, Sydney.

Daniel Kelly appears in the wage book in the "Faithfull Family Papers" held at the National Library Canberra as receiving wages as a stonemason employed to build, in the early 1840s, the "Springfield Homestead" at Quialigo, Goulburn for William Pitt Faithfull (1806-1896).
