Family[]
Judge Callaway was the son of Rev. Dr. Brantly Mercer Callaway (1838-1902) and Lucy Brooks Howard (1837-1915). He married in Newnan, Coweta County, Georgia on February 23, 1888 Mary Eugenia Jones (1864-1901), daughter of Maj. George Jones (1825-1900) and Catherine Lucretia Calhoun (1835-1911). Her mother, known as "Kate," was a native of Tuskegee, Macon County, Alabama and the great-niece of U.S. Vice-President John Caldwell Calhoun (1782-1850).
Career[]
Callaway was an instructor at Waynesboro Academy and later principal of the Washington Male Academy in Wilkes Co. He studied law in the office of Judge William Reese in Crawfordville, Georgia and after being admitted to the bar practiced law as a partner of Judge E. F. Lawton in Waynesboro.
In 1886, Callaway was named chairman of the Burke County, Georgia Democratic Executive committee, and in 1888 was a presidential elector from Georgia, casting his ballot for Grover Cleveland. In 1889 he was elected mayor of Waynesboro, Georgia and served for two years as state senator from the district comprising Burke, Screven and Bullock counties.
In 1894, he was elected judge of the Superior Court of the Augusta Circuit and in 1897 moved to Augusta. In 1899 he retired from the bench and resumed his private practice of law. In 1905 he became a member of the law firm of Lamar & Callaway. Judge Joseph Rucker Lamar (1857-1916) resigned from the supreme court bench to join Judge Callaway and their firm continued until 1910 when Judge Lamar was appointed to the Supreme Court of the United States by President William Howard Taft (1857-1930). He later formed a partnership with his half first cousin U.S. Congressman William Marcellus Howard (1857-1932) which continued until failing health forced him to retire.
Judge Callaway served as a trustee of Mercer College (now Mercer University), Shorter College, the Georgia Normal School in Milledgeville and the University of Georgia. From 1912 to 1932, he was a member of the state tax commission.
